The Curacao Investors Permit

Guidelines “Investors permit 2014”

The “Investors Permit 2014” is a residence permit for bonafide foreign high net worth investors who for reasons of their own wish to reside in Curaçao for a certain period of time.

The goal of the Guidelines Invertors Permit is to facilitate the investment in Curaçao by high net worth foreigners (among others, purchase of real estate property or making a business investment), thus contributing to our economy.

The guidelines contain among others, conditions and requirements, which have to be satisfied by the foreign high net worth investor, in order to qualify for an “Investors Permit 2014”

Conditions for residence of investors

For the temporary residence permit designated as “high net worth investor” it is required that the foreigner shall continuously and independently dispose of sufficient means to satisfy  the obligations issuing from the investment, whereby the foreigner shall show, by presenting official documents that he has made or intents to make a business investment of at least ANG. 500.000,00

The permit shall be issued for periods of one year at a time whereby the first permit issued is for temporary residence or for residence. The subsequent periods shall contain a promise to issue the permit,  which shall be converted into a permit pursuant to a positive review as consequence of an internal appraisal by the Immigration Services (Toelatingsorganisatie) well ahead of the relevant period.

In case of a business investment of at least ANG.500.000,- a residence permit for a period of 3 years shall be issued and will be renewed for similar periods if the circumstances remain unchanged. In case the requirements to obtain an extension are not complied with in time, the permit shall lapse.

In case of a business investment of at least ANG.750.000,- a residence permit for a period of 5 years shall be issued and will be renewed for similar periods if the circumstances remain unchanged. In case the requirements to obtain an extension are not complied with in time, the permit shall lapse.

In case of a business investment of at least ANG.1.500.000,- a residence permit for an indefinite period shall be issued.

For consideration of a request for a residence permit for a period of 3 years, payment of government fees in the amount of ANG.1.720,- and charges of ANG.145,- is required.

For consideration of a request for a residence permit for a period of 5 years, payment of government fees in the amount of ANG.2.860,- and charges of ANG.235,- is required.

For consideration of a request for an indefinite residence permit, payment of government fees in the amount of ANG.5.710,- and charges of ANG.460,- is required.

Periodic assessments will be carried out before expiration of a period; if it is found that action or omission in contravention of the permit conditions occurred, the permit shall be revoked and the payment corresponding to the unused period in which no permit existed shall be refunded when the revocation decision shall have become final.

A little bit of History

The inner city of Willemstad with its many monuments are in the cultural-historical sense very valuable and unique in the region. For this reason in 1995 the inner city received the protected cityscape status in the Island Development Plan for Curaçao. This means that not only the buildings, but also the structure and the appearance of the city are protected.

In December 1997 parts of historical Willemstad were placed on the World Heritage List of UNESCO. The designation was submitted by the Government of the Island Territory of Curaçao and is a worldwide recognition of the cultural-historical value of the city.

 

The Curaçao Monuments Fund Foundation

The Curaçao Monuments Fund Foundation is a “non-profit” organization established in august 1992 by the Government and private enterprise to carry out the Monuments Plan decreed by the Government in 1990.

The objective of the Curaçao Monuments Fund Foundation is to stimulate the restoration and preservation of monuments, within the framework of the objectives of the Island Territory of Curaçao, by granting financing facilities and by giving the necessary information with regards to the restoration and preservation of monuments.

The Curaçao Monuments Fund Foundation gives a combination of subsidies and loans. This means  the owner of a protected monument cannot make an appeal to receive only  subsidy. When the owner makes an appeal, he/she must also take out a loan in the form of a restoration mortgage to help cover the restoration costs.

 
The Restoration Mortgage

Besides the subsidizable costs and the obligatory loan, the costs that are not

subsidizable can also be financed by the Curaçao Monuments Fund Foundation in the form of a supplemental loan.  These loans (obligatory and supplemental) are issued in the form of a restoration mortgage with the monument as collateral.

The interest is 9 % with a minimum period of 5 years and a maximum of 15 years for monuments with commercial purposes and 20 years for monuments with residential purposes.  The creditworthiness of the petitioner plays a role when assessing the petition for a restoration mortgage.

A month after the completion date the monthly repayment of the restoration mortgage goes into effect.

 

Duties of a Monument Owner

An owner has the duty to restore and preserve a protected monument. Once designated as a protected monument, these buildings may not undergo any changes which will undo their historical value as mentioned in the description. For each intervention which leads to changes, the owner must apply for a monument license before starting any building activity. If, under exceptional circumstances, the owner wishes to demolish the protected monument, he/she has to apply also for a demolition permit.

Opposite these duties the owner has in principle the right to receive restoration and maintenance subsidy.
